These terms and conditions set out the basis on which you can visit our website, and order and buy goods through our online delivery service.

We aim to process all enquiries and requests as quickly as possible, but we reserve the right to restrict, refuse or cancel orders, as well as refuse access to the website and terminate accounts at our discretion. This website is intended for use by UK adult consumers only and for delivery within the UK.

We reserve the right to vary these terms and conditions at any time, but in respect of any ordered goods, the terms and conditions which apply shall be those which you accepted when placing your order.

We are thrilled to have shared your child's first shoe experience with you. We hope that you will cherish your animation.
Please take the opportunity to read the remainder of these terms and conditions carefully, followed by our privacy policy. They set out the basis on which you engage with the Clarks Moments experience and how we process any personal data we collect from you, or that you provide to us.
For the purpose of the Data Protection Act 1998, the data controller is C & J Clark International Limited of 40 High Street, Somerset, BA16 0EQ.
C & J Clark International Limited ("Clarks") is committed to protecting and respecting your privacy.

1. General
1.1. This agreement sets out the Clarks Moments terms and conditions.
1.2. We provide the Clarks Moments animation to you without monetary charge or any other form of financial consideration, and the price paid for your child's First Shoes is unchanged, whether or not you decide to receive your animation.
1.3. Your animation is only available through Clarks Kids Facebook page. No exchange, refund or cash alternative is available.
1.4. Whilst we are committed to causing no harm or loss to you or your property please read carefully clause 5.

2. Our responsibilities.
2.1. We are committed to storing and processing your personal data and the animation securely and safely and in accordance with our obligations under the Data Protection Act 1998.
2.2. In order to provide you with the Clarks Moments animation we will be using trusted and responsible third parties, which include our animation partner, EchoMany Limited. Please be aware that your decision to receive your animation will mean that your child's image will be shared with our third party providers but only to the extent strictly necessary to enable you to receive your Clarks Moments animation.
We know that your personal data and the image of your child are precious. Each of our third parties provides a level of security and safety that complies with the law and adequately protects your privacy.

3. Your decision to share your animation
3.1. Once you have received your animation we cannot accept any liability for your decision to share this with any third party or your decision to post the image on any social media platform. Please ensure that you check the privacy terms of any third party social media provider to ensure you are happy with the way they will process and store your animation.

4. Copyright and other Intellectual Property Rights
4.1. The photographer capturing the image will retain full, unlimited, worldwide copyright and other intellectual property rights in the photograph but you grant us an exclusive, worldwide and royalty free licence to store and use the photograph, but only to the extent required to create the Clarks Moments animation on your behalf.
4.2. All rights, including copyright, in the text, graphics and layout of the Clarks Moments animation and in all software and software compilations are owned by, or licensed to us.
4.3. Clarks, the Clarks logo, and First Shoes are registered trademarks of C & J Clark International Limited.

5. Liability
5.1. We do not limit or exclude our liability for death or personal injury caused by our negligence or fraud. Apart from that, we shall have no liability to you arising from or in connection with this agreement, including for: (i) your participation in the Clarks Moments experience; or (ii) your inability to use or participate in the Clarks Moments experience; or (iii) a failure, suspension or withdrawal of all or part of the Clarks Moments experience at any time; or (iv) any loss or liability you incur; unless we have breached this agreement or a legal obligation we have to you that is not set out in this agreement.
5.2. Under no circumstances (including where we have breached this agreement or a legal obligation we have to you that is not set out in this agreement) shall we have any liability to you arising from or in connection with this agreement where we could not reasonably anticipate the type of loss you have suffered would occur because of our breach of this agreement or a legal obligation we have that is not set out in this agreement.
5.3. Subject always to clauses 5.1 – 5.2 above, our total liability to you, however it arises, shall not exceed £100.00 for any one incident and £200.00 for all claims in the aggregate in any 12 month period.
5.4. We consider the limitations and exclusions of liability set out in clauses 5.1 – 5.3 are fair and reasonable taking account of the charges that apply for your participation in the Clarks Moments experience and the fact you have complete discretion as to whether or not to participate in the Clarks Moments experience.

Pricing

Clarks has taken every care in the preparation of the content of this website, in particular we try to ensure that all the prices shown on the website are accurate. Where a product's correct price is lower than that paid, we will refund the difference to you, and despatch your order in the usual way. Where the correct price is higher you will have the option of proceeding with the order at the correct price, or canceling the order. Where a reduced price is shown on sale, the item(s) have been on sale at the higher price for 28 days or more.

Reduced products will show the 'now price' and 'was price' with banners reflecting the discount level by £ off or % off. The reductions shown are reductions from the original ('was price') charged on the website.

Pricing and availability information is subject to change without notice.

All prices are quoted in UK pounds sterling. All prices are inclusive of sales tax where appropriate but do not include delivery charges.

How your order is processed

After you have placed an order with us, we will send an email acknowledgment of that order to your designated email address. This email is a confirmation and receipt of your order.

If after we have confirmed your order we discover any unforeseen reason as to why we cannot complete it, we will cancel your order, in full or in part, and advise you by email, text or phone call, and refund when necessary.

Availability

Our receipt of your offer to purchase our goods is subject to their availability. Our acknowledgment of order acceptance via the web or email is not a guarantee of delivery. If we are unable to deliver the goods which you have offered to purchase we will tell you as quickly as possible and a full refund will be given. Please note that despatch estimates are not guaranteed and that despatch times should not be relied upon as such.

Payment

Payment can be made using the following major credit and debit cards: Visa, Mastercard, Maestro, and Electron. Payments can also be made via PayPal. Please note: as of 28th Feb 2011, we no longer accept Solo as a method of payment.

Governing law and jurisdiction

The agreement between us shall be governed by and interpreted in accordance with English law and the jurisdiction of English courts.

These terms and conditions, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the goods to you by us. Nothing said by any person on our behalf should be understood as a variation of these terms and conditions.

Delivery

All deliveries are subject to stock availability and authorisation of your payment.

We can either deliver your order to an address of your choice or a selected Clarks store. The delivery address must be in the UK, and hold a valid postcode. We do not deliver to Eire or BFPO addresses.

For home delivery, the delivery charge is the same, irrespective of the number of items ordered. (The maximum order you will be able to make is sixteen items/pairs of shoes, of which no more than two sizes can be of the same style).

Standard Delivery

For mainland UK and Northern Ireland there is a standard home delivery charge of £3 for online orders under £50. Online orders £50 and over are eligible for free standard delivery. Delivery is within 3-4 working days for mainland UK and Northern Ireland, and within seven days for outlaying areas. Orders being delivered to the Channel Islands will take between 7-10 days.

By providing us with your mobile phone number and email address when placing your order, our parcel carrier will be able to text/email you when your item is on its way.

Next Day Delivery

The next day delivery service applies on orders placed before 8pm Sunday - Friday for delivery the next working day. Orders placed on Saturday will be delivered on Monday. The next day delivery service is only available in areas as specified by our courier service. If the service is not available in your area it will not be shown as an option once you have selected your delivery address. Delivery times cannot be guaranteed.

Deliveries are normally made Monday-Saturday from 8am-8pm (excluding Bank Holidays). You will receive a confirmation of despatch to your chosen email account, and you can track your items by logging into your account on the Clarks website.

Please be aware that during peak trading times it may take 1-2 days longer for your order to arrive. If you have any questions about the delivery of your order, please call our customer care team on 01458 899904. Lines are open Monday to Friday 8.30am to 8pm and Saturday 8:30am to 6pm (Bank Holiday openings may differ please see our Contact Us page for more details).

Delivery Into Store

Orders can be placed and paid for online then delivered into Clarks stores for free.

Delivery to the store specified by you at the time of order will be within 3-4 working days. You will receive an email or SMS confirmation that your order has arrived. Should you NOT collect your purchase within 14 days of the order arriving in store, your account will be refunded within a further 14 days.

Returns

We make every effort to ensure that your order is carefully despatched to you, and we hope that you're happy with your purchase. However, if you have any cause for dissatisfaction with your goods you may return them.

Items must be in their original condition, unworn and returned within 28 days of receiving them. You should follow the procedure below.

i) Direct to a Clarks store

For an immediate refund, you can return the items to any Clarks store, (with the exception of outlet/discount stores, Wholesale and stores in Eire), within 28 days. You may also exchange your items in store. For a full list of all Clarks stores please click here to see our website Store Locator.

What to do:-

Take your items to be returned to the Clarks store of your choice. You MUST have:

Your despatch note and a completed returns note (at the bottom of your despatch document)

The credit/debit card used to make the original purchase

If the item is in its original condition, we will process the refund for you.

ii) Return by post

You can return any items to us, free of charge at any Post Office or over 5,500 Collect+ stores, within 28 days of receipt.

What to do:-

Complete and detach the returns note (at the bottom of your despatch document) and enclose it, together with your returned items, inside the original packaging. Goods cannot be returned without this information.

Returns via Post Office;

Peel off the returns label from your delivery note and attach it on the outside of the parcel over your address.

Take your parcel to any Post Office, remembering to obtain a Proof of Postage receipt. You must retain this until the item(s) are credited on your statement, as this enables us to trace your order.

Returns via a Collect+ store;

Write your order number on the Collect+ label

Peel off the returns label from the Collect+ document and attach it on the outside of the parcel over your address

Take your parcel to any of the 5,500 local Collect+ stores. You'll receive proof of postage and a code to track your return online. You must retain this until the item(s) are credited on your statement, as this enables us to trace your order.

We cannot process any exchange requests by post. If you require an exchange, please take your item to a store of your choice and we will be happy to help. We will process your refund within 14 days of receiving your return.

All of this is in addition to and does not affect your statutory rights.

Right to cancel this agreement

Under the Consumer Contracts regulations 2013, you have the right to cancel your agreement with Clarks within a period of 14 calendar days. This period begins the day after you receive the goods. Please contact us as soon as possible to notify us of your cancellation request. If your order has already been dispatched then you will need to either refuse delivery or return the goods, click here for further details on our returns policy. Refunds will be processed within 14 days of receipt of the product. Goods must be returned before a refund will be processed and the product must be returned in its original condition.

How you can cancel this agreement

Please contact us as soon as possible if you wish to cancel your agreement, you can do so by writing to us, calling 01458 899904, or by completing our cancellation form here. Orders can only be cancelled before processing/despatch has begun.

Once your order has been cancelled, any sum debited from your payment card by us will be re-credited to your account as soon as possible. If cancelled orders are erroneously delivered to you, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.

How Clarks can cancel this agreement

We reserve the right to cancel the order if:-

We have insufficient stock to fulfill your order

We are unable to obtain payment

We do not deliver to your area

A product fault or an error in the product description has been identified

Ownership of rights

All rights, including copyright, in the text, graphics and layout of this website and in all software and software compilations are owned by, or licensed to, Clarks.

You are not permitted, without our prior written consent, to copy, transmit, reproduce, publish, display, distribute, store, modify or adapt this website, its contents or underlying software, except for personal non-commercial use.

Accuracy of content

We have made every effort to ensure that the products are fairly described, that the product information is correct, and that the colours of our products are displayed as accurately as possible. However, as the actual colours you see will vary with the quality of your monitor, we cannot guarantee that your display will accurately reflect the colour of the product requested on delivery.

If, on receiving ordered goods, you have any cause for dissatisfaction you may return them via our Returns procedure, which is explained below.

We may establish general practices and limits concerning the use of the website and the services we provide, including limits to the size and number of any messages that have been sent, or the duration that any messages may be stored on our website. We are entitled to delete any material from our website at any time, and we will not be liable for deleting or not storing any material that you may transmit to us.

Damage to your computer

Clarks make every effort to ensure that this website is free from defects or viruses. It is your responsibility to ensure that you use the correct equipment when using the website, and to protect from anything that may damage it.

Links to other websites

We take no responsibility for the content or operation of third party websites that you may access following links from this website. We strongly advise that you read the privacy policy and terms and conditions relating to any third party websites that you visit.

We do not hold any responsibility for any site, or its content, that has chosen to link to us.

Product reviews

You may leave a review of a product on its specific product page. We will review product and publish product reviews within 4-5 working days of posting, and we will directly contact a customer where a review indicates a problem with a product. If we choose not to post a review we will contact the customer via their Clarks account to explain why. We reserve the right to edit or delete illegal or inappropriate content. We will not change a rating once set by a customer.

We reserve the right to use customer reviews (in full or part) in our marketing materials. These may include in-store, online, email and direct mail marketing.

Telephone Number charges

Calls to our Appointment Line 0844 2488408 and our Stores with numbers beginning 0844 will cost 7 pence per minute plus your providers access charge.

Password and security

If you use the site, you are responsible for maintaining the confidentiality of your account and password, and also for ensuring that unauthorised access to your account is prohibited. You should take all necessary steps to ensure that your information is kept confidential to you and we would therefore recommend that you use a password unique to Clarks. If you have reason to believe that this may have been compromised, please contact us immediately.

Complaints and your rights

If you have a complaint about any goods you purchase from us please contact us so our Customer Care team can help you.

If we cannot resolve a complaint to your satisfaction you can contact an independent, impartial third party who will consider your complaint and help us to come to an agreement. This is an alternative to bringing a court case. We agree to use ProMediate for this type of dispute resolution. You can contact ProMediate by email: enquiries@promediate.co.uk.
