These Terms apply to all users (including ‘you’) of our website www.clarks.co.uk (the “Website”) and the Services. By using the Services, you are agreeing to these Terms, along with the following additional terms, which also apply:

- Who we are and how to contact us

We will contact you by email to the email address provided by you when booking the Services.
- Our Services
Clarks offers Services which enables you to visit a Clarks store to book a fitting or measuring appointment, or connect online, in real time to an expertly trained shoe fitter (the “Fitter”).
Our Services are available to you if you are in the United Kingdom (England, Wales, Scotland and Northern Ireland). We do not represent that any content available on or through the Services are appropriate for use outside of the United Kingdom.
You can use the Services to:
- book an in-store appointment for measuring and fitting your child’s/children’s feet;
- book an appointment for a virtual measuring session for your child’s/children’s feet;
- book an appointment for a virtual fitting session for shoes already purchased for your child/children;
- obtain suggestions from the Fitter of appropriate shoes on the Website following the measuring session; and
- if confirmed by you to the Fitter, add suggested Clarks products from the Website to your basket online for you to purchase at your option and time following the end of the measuring session
together the “Services”.
In a virtual fitting, suggested products will be added to a virtual basket following your confirmation and emailed to the email address used to book the Service. The Fitter cannot purchase the products on your behalf and the Fitter will not access any Clarks account that you have. The Fitter will not ask or accept any payment details as part of the Services and there is no obligation for you to purchase the suggested products once you receive the virtual basket. All purchases of products are made at your sole discretion.
Booking Services and Appointments
Virtual appointments will be delivered in a twenty-five (25) minute block of time (“Session”) during which you can have a measuring or fitting session with a Fitter for one (1) child. You can also choose to book additional blocks of fifteen (15) minutes per child (to a maximum of six (6) children) in addition to the Session if you require advice on measuring and/or fitting for multiple children. The in-store services will be delivered by a Fitter in-store in a fifteen (15) minute Session per child, and the same restrictions apply (we refer to this collectively as an ““Appointment”” for the purpose of these Terms).
You can request the Appointment on your chosen date and time (subject to availability) via our Measure & Fit hub for virtual appointments and via our In-Store Fitting page for in-store appointments.
Virtual Appointments will automatically end once the block of time booked has been met. These will end five (5) minutes before the allotted block of time to provide the Fitter with a break before their next virtual Appointment i.e. a thirty (30) minute Appointment will end at twenty-five (25) minutes.
If you wish the Fitter to suggest Clarks products following a virtual measuring session, there must be at least five (5) minutes (per child) left of your virtual Appointment. If you do not have this time left at the end of your Appointment, you must book another Appointment for the Fitter to suggest Clarks products. An Appointment may not be available on the same day.
The Services are subject to availability and Appointment times are subject to change.
In the event that:
- There are no Appointment date and/or times that suit your requirements;
- You miss an Appointment for any reason;
- You lose connection during the Appointment; or
- Your Appointment is cancelled, including as a result of a Fitter being unavailable;
it is your sole responsibility to book an alternative Appointment.
If we lose connection during the virtual Appointment, we will try to re-connect. If reconnection fails for reasons in relation to our devices or systems, we will cancel the Appointment and request that you book an alternative Appointment.
Confirmation of the Appointment Service
After you have requested an Appointment you will be sent written confirmation in the form of an email to the email address that you provided when booking the Appointment. If you do not receive a confirmation of the Appointment within one (1) hour of requesting it, please contact us via the details in paragraph 2 “who we are and contact us” to check we have received your booking request.
Making a change to or cancelling a booking of the Appointment Service
If you wish to make a change to the date and/or time of your Appointment visit the Appointment Lookup Page and choose an available date and time for your new Appointment. If you are having difficulties changing an Appointment and you need our help, please contact us via the details in paragraph 2 “who we are and contact us”.
Changes to an Appointment can be made up to 11pm (23:00) the day before it is due to commence. If we can make a change to your Appointment, we will let you know as soon as possible, together with the changes to the date and/or time of your Appointment and ask you to confirm if you wish to accept the changes. If the changes to the Appointment are unacceptable for you, you may cancel it.
You can cancel an Appointment up until the time it is due to commence by visiting the Appointment Lookup Page and selecting to cancel your Appointment.
We will contact you as soon as possible if we need to make any changes to your Appointment.
- Safe use of the Appointment Service and Website
To ensure that you use the Services safely and in accordance with these Terms, you must:
- not use the Services for any inappropriate purposes;
- not use the Services for commercial purposes; and
- follow the instructions given to you during the Appointment by the Fitter.
You are not permitted to (or permit anyone else to):
- use the Services and/or Website in any unlawful or fraudulent way and/or for any unlawful, fraudulent or inappropriate purpose;
- use the Services or Website for the purpose of harming or attempting to harm minors in any way;
- post or transmit a message (written, verbal or via video) under a false name or use our network resources to impersonate another person or misrepresent authorisation to act on behalf of others;
- allow another person to join the Appointment (except the person permitted to which the Appointment is made for and you are present throughout the Appointment);
- market, promote or solicit the Services except as expressly permitted by these Terms;
- attempt to undermine the security or integrity of computing systems or networks of Clarks, the Services and/or the Website and you must not attempt to gain unauthorised access;
- vest or collect data about another individual who uses the Website and/or the Services;
- post or transmit any data, materials, content or information which is threatening, false, misleading, abusive, defamatory, derogatory, pornographic or profane, or that contains or promotes any virus, worm, trojan horse, time bomb or other computer programming or code that is designed or intended to damage, destroy, intercept, download, interfere, manipulate or otherwise interrupt or expropriate the Website and/or the Services;
- tamper, hack, spoof, copy, modify or otherwise corrupt or attempt to gain unauthorised access to the administration, security or proper function of the Website and/or the Services, or the server on which the Website or related materials are stored or any server, computer or database connected to the Website and/or Services. You will not use robots or scripts with the Website and/or the Services;
- attempt to reverse engineer, reverse assemble, reverse compile, decompile, disassemble, translate or otherwise alter, defraud or create false results from any executable code or information on or received by the Website and/or the Services. You agree to have anti-virus and/or anti-spyware software running that is set to override the Internet browser's cookie setting;
- upload or provide any information to the Website or any Fitter in breach of any third party's intellectual property rights and/or any obligation of confidentiality or contractual duty owed to any third party; or
- reproduce, duplicate, copy or sell any part of the Website in contravention of the provisions of our Terms.
If any breach is committed of the above, we will take such action as we deem appropriate. Failure to comply with this paragraph constitutes a material breach of the Terms upon which you are permitted to use the Website and the Services.
- Connectivity to the Appointment Services
For a virtual appointment, we will communicate to you during the Appointment through an online video conferencing system called Zoom. To enable you to connect to the Appointment you will need to download or have access to a Zoom account on your desktop, laptop, tablet or smartphone (“Device”). You will need to have a working webcam, sound and microphone on your Device. You will receive an email including the link to connect to the Appointment via Zoom.
You will need to ensure that you have read and understood Zoom’s Terms of Service and Zoom’s Privacy Policy.
Clarks is not responsible for the connectivity or any technical problems between your Device and Zoom and all terms and conditions applicable to Zoom will be accepted at your sole discretion. If you do experience technical problems with Zoom on your Device, you will need to book another Appointment on an alternative date and time.
You are responsible for ensuring you have agreed to any update and/or changes made to Zoom or its Terms of Service and/or Privacy Policy at your own discretion.

- Requirements to use the Services
To book an Appointment you are required to provide accurate and complete information, including your:
- First name
- Last name
- Email address
- Telephone number (we will contact you on this number to resolve any issues with your Appointment); and
- any other information we specifically request.
You must be at least eighteen (18) years of age and have capacity to accept and agree to these Terms. Acceptance of these Terms shall include acceptance on behalf of your child or children the Appointment is booked on behalf of and that you are the legal parent or guardian of that child, or children.
- How we may use your personal information
For further information on how we use your personal information please see our Privacy Policy.
Your Appointment will not be video recorded but Zoom will record and store the audio. We may access this recording, but we do not store the recordings on our systems. You are not permitted to make any form of recording of any Appointment yourself.
- We may make changes to the Services and/or Website
We may update and/or make changes to the Website and/or the Services from time to time, for example, to reflect the changes in your needs and/or our business priorities, security updates and/or legal and regulatory changes. If you are not happy with the changes then we ask that you do not continue to use the Services and cancel any booked Appointment.
- Suspending or withdrawing the Services
We do not agree that the Services will always be available or uninterrupted. We may suspend, withdraw or restrict the availability of all or any part of the Services or the Website for business and operational reasons, including (without limitation) for technical and security reasons. We will try to give you any notice of suspension or withdrawal.
If you have booked an Appointment and we need to suspend access to the Services at any time prior to your Appointment, we will notify you in advance (unless the suspension is due to unforeseen circumstances) and arrange a new Appointment with you as soon as possible.
We reserve the right to suspend or terminate your Appointment at any time, without notice and without bearing any liability to you, if we reasonable believe that you have breached any of these Terms. In such circumstances, the Appointment that you have already booked will be cancelled.
- Circumstances outside of our control
We are responsible to you for foreseeable loss and damage caused by us. If we fail to comply with these Terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking of the Terms or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen, for example, if you discussed it with us during the sales process.
We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability to compensate you for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; or for fraud or fraudulent misrepresentation.
For any defective digital content which Zoom have supplied damages your Device or digital content belonging to you and this is caused by Zoom’s failure to use reasonable care and skill your remedies will be in accordance with Zoom’s terms and conditions.
We are not liable for business losses. We only supply the Services for domestic and private use. If you use the Services for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
- Intellectual Property
We are the owner or the licensee of all intellectual property rights in the Website and in the material published in or on it. These works are protected by copyright laws and treaties around the world. All such rights are reserved.
You may print off one copy, and may download extracts, of any page(s) from our Website for your personal (non-commercial) use. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. Our status (and that of any identified contributors) as the authors of content on our Website must always be acknowledged.
If you print off, copy or download any part of our Website in breach of these Terms or otherwise breach our intellectual property rights, your right to use our Services will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
- Other important terms
We may transfer our rights and obligations to under these Terms to another organisation. We will always tell you in writing if this happens.
No third party shall have the rights to enforce any of these Terms.
Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
These Terms are governed by English law and you can bring legal proceedings in respect of the Appointment Services in the English courts.

After you have placed an order with us, we will send an email acknowledgment of that order to your designated email address. This email is a confirmation and receipt of your order.
If after we have confirmed your order we discover any unforeseen reason as to why we cannot complete it, we will cancel your order, in full or in part, and advise you by email, text or phone call, and refund when necessary.
Our receipt of your offer to purchase our goods is subject to their availability. Our acknowledgment of order acceptance via the web or email is not a guarantee of delivery. If we are unable to deliver the goods which you have offered to purchase we will tell you as quickly as possible and a full refund will be given. Please note that dispatch estimates are not guaranteed and that dispatch times should not be relied upon as such.

These terms and conditions, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the goods to you by us. Nothing said by any person on our behalf should be understood as a variation of these terms and conditions.
All deliveries are subject to stock availability and authorisation of your payment.
We can either deliver your order to an address of your choice or a selected Clarks store. The delivery address must be in the UK, and hold a valid postcode. We do not deliver to Eire or BFPO addresses.
For home delivery, the delivery charge is the same, irrespective of the number of items ordered. (The maximum order you will be able to make is sixteen items/pairs of shoes, of which no more than two sizes can be of the same style).
Standard Delivery
For mainland UK and Northern Ireland there is a standard home delivery charge of £3.95 for online orders under £75. Online orders £75 and over are eligible for Free standard delivery. Delivery is within 3 - 4 working days for mainland UK and Northern Ireland, and within seven days for outlaying areas. Orders being delivered to the Channel Islands will take between 7 - 10 days.
By providing us with your mobile phone number and email address when placing your order, our parcel carrier will be able to text/email you when your item is on its way.
DPD next day delivery
The Next Day Delivery service applies on orders placed before 7pm Sunday - Friday for delivery the next working day. Orders placed on Saturday will be delivered on Monday. The Next Day Delivery service is only available in areas as specified by our courier service. If the service is not available in your area it will not be shown as an option once you have selected your delivery address. Delivery times cannot be guaranteed.
Deliveries are normally made Monday-Sunday from 8am-6:30pm (excluding Bank Holidays). You will receive a confirmation of dispatch to your chosen email account, and you can track your items by logging into your account on the Clarks website.
Delivery Delays
Please be aware that during peak trading times it may take 1 - 2 days longer for your order to arrive. If you have any questions about the delivery of your order, please call our customer care team on 01458 899904. Lines are open Monday to Friday 8.30am to 8pm and Saturday 8:30am to 6pm (Bank Holiday openings may differ please see our Contact Us page for more details).
Delivery Into Store
Orders can be placed and paid for online then delivered into Clarks stores for Free.
Delivery to the store specified by you at the time of order will be within 4 working days. You will receive an email or SMS confirmation that your order has arrived. Should you NOT collect your purchase within 14 days of the order arriving in store, your account will be refunded within a further 14 days.
We make every effort to ensure that your order is carefully dispatched to you, and we hope that you're happy with your purchase. However, if you have any cause for dissatisfaction with your goods you may return them.
Items must be in their original condition, unworn and returned within 28 days of receipt, or for items purchased in a sale within 14 days. You should follow the procedure below.
Direct to a Clarks store
For an immediate refund, you can return the items to any Clarks store, (with the exception of outlet stores, Wholesale and stores in Eire), within 28 days (14 days for items purchased in a sale). Please note, online orders paid for using Klarna cannot be refunded or exchanged in store, please return to our distribution centre for a refund to your original payment method.
What to do:-
Take your items to be returned to the Clarks store of your choice. You MUST have:
Your original dispatch/ packing note and the credit/debit card used to make the original purchase.
If the item is in its original condition, we will process the refund for you.
Return by post
You can return any items to us, free of charge at any Post Office, CollectPlus store or Hermes drop off point, within 28 days of receipt (14 days for items purchased in a sale).
What to do:-
Go to our Online Returns Portal
You will be prompted to enter your order number (e.g. 612345678) and delivery or billing postcode.
Select the item(s) that you would like to return & the returns reason.
Select your preferred returns method.
Re-enter your email address and home address when prompted – this will be used for return delivery notifications & if the carrier needs to return the parcel to sender.
Download your label and attach it to your parcel - take the parcel to your selected drop off point, or present the QR code that will be emailed to you to the store and they can generate and print a returns label in store for you.
We cannot process any exchange requests by post. If you require an exchange, please take your item to a store of your choice and we will be happy to help. We will process your refund within 14 days of receiving your return.

Clarks, Tottenham Court Road
This returns policy applies to Desert Boots purchased and customised in-store at the Desert Boot customisation station operating from Monday 2 March 2020 at the Clarks London Tottenham Court store.
Customised Desert Boots are non-refundable and non-exchangeable following purchase, unless found to be faulty.
If your customised Desert Boots are faulty please return them in-store or by post within 6 months from the date of purchase for a full refund. A refund will not be offered following 6 months from the date of purchase. This does not affect your statutory rights.
Refunds by post will be processed once the customised Desert Boots are received.
You must provide your receipt as proof of proof of purchase. If you don’t have your receipt, you can supply us with a credit card or bank statement as proof of purchase. Please remove your payment card number by cutting out the details or by covering the number, then scanning your documents.
Please allow at least 14 days for the refund to be credited back to your bank account.

Under the Consumer Contracts regulations 2013, you have the right to cancel your agreement with Clarks within a period of 14 calendar days. This period begins the day after you receive the goods. Please contact us as soon as possible to notify us of your cancellation request. If your order has already been dispatched then you will need to either refuse delivery or return the goods. Find further details in our Returns Policy. Refunds will be processed within 14 days of receipt of the product. Goods must be returned before a refund will be processed and the product must be returned in its original condition.
Please contact us within 14 days after you have received your order if you wish to cancel your agreement.
Once your order has been cancelled, any sum debited from your payment card by us will be re-credited to your account as soon as possible. If cancelled orders are erroneously delivered to you, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.
We reserve the right to cancel the order if:-
- We have insufficient stock to fulfill your order
- We are unable to obtain payment
- We do not deliver to your area
- A product fault or an error in the product description has been identified

Grant of Rights
For good and valuable consideration, including the opportunity to have your Material used by Clarks for promotional purposes, you hereby shall grant to C. & J. Clark International Limited. and its subsidiaries and affiliates (“Clarks”) a perpetual, worldwide, irrevocable, freely transferable and sublicensable, royalty-free right license to use your photographs, video, or other content (“Materials”), including those bearing your likeness, name, voice, image and/or any other identifiable representation, including all copyrights and other intellectual property rights therein, in all formats and media, whether now known and existing or hereafter discovered or developed, including on any social media platform, in-store displays, emails, electronic media, print, out of home, or any other formats and media, for all or any purposes whatsoever without further notice, consent or payment to you. The foregoing grant includes the rights: (a) to modify, edit, scan, morph, alter, combine with other materials, translate, include in collective works, and create derivative works of the Materials; and (b) to reproduce, post, display, stream, exploit, transmit or otherwise use the Materials. You hereby waive any right you may have to inspect or approve the finished Materials in any way.
Representations and Warranties
You represent and warrant that: (a) the Material is your own original work (b) you own the Material, or have the right to grant us rights to the Material (c) you have obtained any necessary permission from individuals featured in your Materials to use their image and likeness (d) you are 18 years of age or older (e) the Material does not infringe the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any third parties; and (f) the Material does not violate any applicable law. You agree that Clarks shall not be liable for any losses or damages of any kind resulting from Clarks use of the Material. You agree to indemnify and hold Clarks harmless against any such losses or damage.
Clarks Gift Cards and/or eGift (Gift Tender) may only be used in our stand alone stores or Outlet Stores within the UK & ROI. Gift Tender may not be used in Clarks Wholesale stockists or online.
Gift Tender expires 24 months from last use. (Last use means a purchase, top up or part redemption). Any balance remaining will be cancelled. ROI gift tender will expire 60 months from purchase or last use.
Once activated, the Clarks Gift Tender is redeemable for full or part payment of a transaction. The amount of your purchase will be deducted from the balance on the card.
Gift Tender cannot be returned, refunded or exchanged for cash, except in accordance with your legal rights.
Gift Tender cannot be resold, transferred for value or exchanged for cash. No cash change will be given on purchases made using Gift Tender.
Please treat your Gift Tender as cash, Clarks cannot be responsible for lost, damaged or stolen cards and cannot be replaced.
Clarks reserves the right to refuse to accept any Gift Tender which it deems to have been tampered with, defaced, modified, duplicated, damaged, or which otherwise is suspected to be affected from fraud.
By purchasing, using or accepting Gift Tender you confirm your acknowledgement and acceptance of these terms and conditions. Clarks reserves the right to amend these terms and conditions from time to time, without notice and to take appropriate action, including the cancellation of Gift Tender, if, in its discretion, it deems such action necessary. This does not affect your legal rights.
The minimum amount to activate or top up a Gift Tender is £5, or in the case of Gift Tender issued in the ROI €5 and the maximum Gift Tender limit is £500, or in the case of Gift Tender issued in the ROI €500.
Gift Tender can be topped up at any till point in store by informing the sales advisor of the amount to be added. Gift Tender cannot be resold.
There are no limitations on how many times Gift Tender can be used (until the balance is £0.00). Your Gift Tender balance may be checked in store or online at www.clarks.co.uk/giftcards

A maximum of five Gift Tender can be used in one transaction.

Clarks makes no warranties, express or implied, with respect of Gift Cards, including without limitation, any express or implied warranty of merchantability or fitness for a particular purpose.
The risk in any eGift shall pass to you upon Clarks electronic transmission to you. The eGift remains the property of Clarks, and may not be tampered or interfered with, without Clarks consent. If eGift Voucher is found, please return to the nearest Clarks store.
eGifts will be dispatched via email to the designated email account provided to us. This will happen as soon as Clarks is in receipt of cleared payment for the eGift.
Clarks shall not be liable or responsible for eGift that are unable to be delivered due to your error (for example, typing errors, misspelt or incorrect email addresses), spam filters, firewalls or mailbox restrictions.
Clarks will not issue paper Gift Vouchers going forward. Existing paper Gift vouchers will still be honored in store for two years from the date of purchase.
Paper gift vouchers are only valid with a unique serial number on the reverse. A maximum of five paper gift vouchers can be used in one transaction.
