We reserve the right to vary these terms and conditions at any time, but in respect of any ordered goods, the terms and conditions which apply shall be those which you accepted when placing your order.

We are thrilled to have shared your baby's first shoe experience with you. We hope that you will cherish your photograph.

The 'Clarks First Shoes Experience' ("the First Shoes Experience") includes the First Shoes Mobile App, ("the App"), the First Shoes In-Store App ("the In-Store App"), the Digital Image and the Photograph.

Please take the opportunity to read the remainder of these terms and conditions carefully, followed by our privacy policy. They set out the basis on which you engage with the First Shoes Experience and how we process any personal data we collect from you, or that you provide to us.

For the purpose of the Data Protection Act 1998, the data controller is C & J Clark International Limited of 40 High Street, Somerset, BA16 0EQ.

C & J Clark International Limited ("Clarks") is committed to protecting and respecting your privacy.

1. General

1.1. This agreement sets out the First Shoes Experience terms and conditions. By confirming your address details are correct using the ['Confirm'] button in the email you confirm you have understood and accepted these terms.

1.2. We provide the First Shoes Experience to you without monetary charge or any other form of financial consideration, and the price paid for your baby’s First Shoes is unchanged, whether or not you decide to receive your Photograph.

1.3. Your Photograph is only available through Clarks participating stores and is subject to availability. No exchange, refund or cash alternative is available.

1.4. Whilst we are committed to causing no harm or loss to you or your property please read carefully clause 8.

2. Our responsibilities.

2.1. We are committed to storing and processing your personal data and the Digital Image securely and safely and in accordance with our obligations under the Data Protection Act 1998.

2.2. In order to provide you with the First Shoes Experience, provide the Digital Image, and print and deliver your Photograph, we will be using trusted and responsible third parties, which include our mobile app designer, our database manager, and our print provider. Please be aware that your decision to receive your Digital Image and Photograph will mean that your baby’s image will be shared with our third party providers but only to the extent strictly necessary for your participation in the First Shoes Experience.

2.3. We know that your personal data and the image of your baby are precious. Each of our third parties provides a level of security and safety that complies with the law and adequately protects your privacy. Once the Digital Image has been supplied to you and the Photograph dispatched the image will only be retained for a further 21 days, after which it will be deleted by each of our third parties.

3. Your decision to share your Digital Image

3.1. Once you have received your Digital Image we cannot accept any liability for your decision to share this with any third party or your decision to post the image on any social media platform. Please ensure that you check the privacy terms of any third party social media provider to ensure you are happy with the way they will process and store your Digital Image.

4. Colour and Image Quality of your Photograph

4.1. We will make every effort to produce for you a special memento of your baby's first shoes, however for colour and image quality reasons we may:

4.1.1. make changes to the image size (in the unlikely event that we need to make any adjustments to the Photograph size we will do all we can to preserve the original look and feel of the captured moment);

4.1.2. make changes to the colour, so there may not be an exact colour match to the original image (and colours in the Photograph may not match exactly to the Digital Image when viewed on screen);

4.1.3. make changes to the quality of your image (which will be dictated in part by the picture quality and the technical specifications of your personal device and integral camera facility, and we will assume that you are aware of the resolution and capabilities of the personal device used to capture the image).

5. Delivery of your Photograph

5.1. Once you have confirmed that the postal address is correct your Photograph will be processed and dispatched automatically. We are unable to suspend, hold, cancel or prevent the dispatch of your Photograph once we have confirmed your postal address is correct.

5.2. We are unable to provide any guarantees as to how long it will take to process and print your Photograph, which will be subject to current demand.

5.3. We can only deliver your Photograph to a full postal address in the United Kingdom and the Republic of Ireland.

5.4. The Photograph will be dispatched by [first class/second class] post by Royal Mail. We cannot give you any guarantee of delivery times and cannot accept any liability for any loss or damage caused to your Photograph once it has been dispatched.

6. Copies and Replacement Photographs

6.1. The Digital Image held by our third parties will be deleted after 21 days and because of this we are unable to produce or dispatch any copy or replacement Photographs. In the unlikely event that your Photograph is not delivered please visit any one of our participating Clarks store where our staff will be happy to help you capture the moment again.

7. Copyright and other Intellectual Property Rights

7.1. The photographer capturing the image will retain full, unlimited, worldwide copyright and other intellectual property rights in the Photograph but you grant us an exclusive, worldwide and royalty free licence to store and print the Photograph, but only to the extent required to complete the First Shoes Experience on your behalf.

7.2. All rights, including copyright, in the text, graphics and layout of the First Shoes Experience, the App or In-Store App and in all software and software compilations are owned by, or licensed to us.

7.3. You are not permitted, without our prior written consent, to copy, transmit, reproduce, publish, display, distribute, store, modify or adapt the First Shoes Experience, the App or In-Store App, its contents or underlying software.

7.4. Clarks, the Clarks logo, and First Shoes are registered trademarks of C & J Clark International Limited.

8. Liability

8.1. We do not limit or exclude our liability for death or personal injury caused by our negligence or fraud. Apart from that, we shall have no liability to you arising from or in connection with this agreement, including for: (i) your participation in the First Shoe Experience; or (ii) your inability to use or participate in the First Shoe Experience; or (iii) a failure, suspension or withdrawal of all or part of the First Shoe Experience at any time; or (iv) any loss or liability you incur; unless we have breached this agreement or a legal obligation we have to you that is not set out in this agreement.

8.2. Under no circumstances (including where we have breached this agreement or a legal obligation we have to you that is not set out in this agreement) shall we have any liability to you arising from or in connection with this agreement where we could not reasonably anticipate the type of loss you have suffered would occur because of our breach of this agreement or a legal obligation we have this is not set out in this agreement.

8.3. Subject always to clauses 8.1 - 8.2 above, our total liability to you, however it arises, shall not exceed £100.00 for any one incident and £200.00 for all claims in the aggregate in any 12 month period.

8.4. We consider the limitations and exclusions of liability set out in clauses 8.1 - 8.2 are fair and reasonable taking account of the charges that apply for your participation in the First Shoe Experience and the fact you have complete discretion as to whether or not to participate in the First Shoe Experience.

THE PROMOTER
The Prize Draw is operated by C&J Clark International, 40 High Street, Street, Somerset BA16 0EQ referred to in these Terms and Conditions as “we”, “us”, “our”, or “Clarks” according to the context.

By submitting your entry you agree to comply with these Terms and Conditions. If you do not comply with them, your entry may be disqualified from the Prize Draw.

ENTRIES
Entries are open to all residents of the United Kingdom and Northern Ireland except for employees of Clarks, it’s parent and sister companies, and their families or anyone else professionally connected with this promotion.

To enter, participants must fully complete a Prize Draw entry forms available in Clarks stores and give it to a member of store staff. We do not accept responsibility for entries which we do not actually receive, or for any entries which are lost, delayed or become corrupted during electronic transmission. Even if you have proof that you have submitted an entry, this will not constitute proof of receipt by us.

No purchase necessary for entry. Only one entry per person per month is permitted.

Where a product's correct price is lower than that paid, we will refund the difference to you, and despatch your order in the usual way. If after we have confirmed your order we discover any unforeseen reason as to why we cannot complete it, we will cancel your order, in full or in part, and advise you by email, text or phone call, and refund when necessary.

If we are unable to deliver the goods which you have offered to purchase we will tell you as quickly as possible and a full refund will be given. These terms and conditions, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the goods to you by us. Nothing said by any person on our behalf should be understood as a variation of these terms and conditions.

All deliveries are subject to stock availability and authorisation of your payment.

We can either deliver your order to an address of your choice or a selected Clarks store. The delivery address must be in the UK, and hold a valid postcode. We do not deliver to Eire or BFPO addresses.

For home delivery, the delivery charge is the same, irrespective of the number of items ordered. (The maximum order you will be able to make is sixteen items/pairs of shoes, of which no more than two sizes can be of the same style).

Standard Delivery
For mainland UK and Northern Ireland there is no delivery charge for orders placed in store or online. Delivery is within five working days for mainland UK and Northern Ireland, and within seven days for outlaying areas. Orders being delivered to the Channel islands will take between 7-10 days.

By providing us with your mobile phone number and email address when placing your order, our parcel carrier will be able to text/email you when your item is on its way.

Next Day Delivery
The next day delivery service applies on orders placed before 6pm Sunday - Friday for delivery the next working day. Orders placed on Saturday will be delivered on Monday. The next day delivery service is only available in areas as specified by our courier service. If the service is not available in your area it will not be shown as an option once you have selected your delivery address. Delivery times cannot be guaranteed.

Please note that Next Day is a proof-of-delivery service, and requires a signature on delivery.

Deliveries are normally made Monday-Saturday from 8am-8pm (excluding Bank Holidays). You will receive a confirmation of despatch to your chosen email account, and you can track your items by logging into your account on the Clarks website.

Please be aware that during peak trading times it may take 1-2 days longer for your order to arrive.
If you have any questions about the delivery of your order, please call our customer care team on 01458 899904. Lines are open Monday to Friday 8.30am to 8pm and Saturday 8:30am to 6pm (Bank Holiday openings may differ please see our Contact Us page for more details).

For items ordered for collection at store, there is no delivery charge. Delivery to the store specified by you at the time of order will be within five working days. You will receive an email or SMS confirmation that your order has arrived, and it will be held at the store for nine working days for your collection. After this time, the shoes will cease to be reserved for you and will return to general store stock.

We make every effort to ensure that your order is carefully despatched to you, and we hope that you're happy with your purchase. However, if you have any cause for dissatisfaction with your goods you may return them.

Items must be in their original condition, unworn and returned within 28 days of receiving them. You should follow the procedure below.

i) Direct to a Clarks store
For an immediate refund, you can return the items to any Clarks store, (with the exception of the Heathrow airport store, outlet/discount stores, wholesale and stores in Eire), within 28 days. You may also exchange your items in store. For a full list of all Clarks stores please click here to see our website Store Locator.

What to do:-
Take your items to be returned to the Clarks store of your choice. You MUST have:
Your despatch note and a completed returns note (at the bottom of your despatch document)
The credit/debit card used to make the original purchase
If the item is in its original condition, we will process the refund for you.

ii) Return by post
You can return any items to us, free of charge at any Post Office or over 5,500 Collect+ stores, within 28 days of receipt.

What to do:-
Complete and detach the returns note (at the bottom of your despatch document) and enclose it, together with your returned items, inside the original packaging. Goods cannot be returned without this information.
Returns via Post Office;
Peel off the returns label from your delivery note and attach it on the outside of the parcel over your address.
Take your parcel to any Post Office, remembering to obtain a Proof of Postage receipt. You must retain this until the item(s) are credited on your statement, as this enables us to trace your order.
Returns via a Collect+ store;
Write your order number on the Collect+ label
Peel off the returns label from the Collect+ document and attach it on the outside of the parcel over your address
Take your parcel to any of the 5500 local Collect+ stores. You'll receive proof of postage and a code to track your return online. You must retain this until the item(s) are credited on your statement, as this enables us to trace your order.

We cannot process any exchange requests by post. If you require an exchange, please take your item to a store of your choice and we will be happy to help. We will process your refund within 14 days of receiving your return.

Right to cancel this agreement Back to top


Under the Consumer Contracts regulations 2013, you have the right to cancel your agreement with Clarks within a period of 14 calendar days. This period begins the day after you receive the goods. Please contact us as soon as possible to notify us of your cancellation request. If your order has already been dispatched then you will need to either refuse delivery or return the goods, click here for further details on our returns policy. Refunds will be processed within 14 days of receipt of the product. Goods must be returned before a refund will be processed and the product must be returned in its original condition.

Please contact us as soon as possible if you wish to cancel your agreement, you can do so by writing to us, calling 01458 899904, or by completing our cancellation form to do so please click here. Orders can only be cancelled before processing/despatch has begun.

Once your order has been canceled, any sum debited from your payment card by us will be re-credited to your account as soon as possible. If cancelled orders are erroneously delivered to you, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.

We have made every effort to ensure that the products are fairly described, that the product information is correct, and that the colours of our products are displayed as accurately as possible. However, as the actual colours you see will vary with the quality of your monitor, we cannot guarantee that your display will accurately reflect the colour of the product requested on delivery.

If, on receiving ordered goods, you have any cause for dissatisfaction you may return them via our Returns procedure, which is explained below.

We may establish general practices and limits concerning the use of the website and the services we provide, including limits to the size and number of any messages that have been sent, or the duration that any messages may be stored on our website. We are entitled to delete any material from our website at any time, and we will not be liable for deleting or not storing any material that you may transmit to us.

We will review product and publish product reviews within 4-5 working days of posting, and we will directly contact a customer where a review indicates a problem with a product. If we choose not to post a review we will contact the customer via their Clarks account to explain why. We reserve the right to edit or delete illegal or inappropriate content. We will not change a rating once set by a customer.

We reserve the right to use customer reviews (in full or part) in our marketing materials. These may include in-store, online, email and direct mail marketing.
