These terms and conditions set out the basis on which you can visit our website, and order and buy goods through our online delivery service.

Please read through these terms and conditions carefully before using this website, and also read our Privacy Policy regarding your personal information.

We aim to process all enquires and requests as quickly as possible, but we reserve the right to restrict, refuse or cancel orders, as well as refuse access to the website and terminate accounts at our discretion. This website is intended for use by UK adult residents and consumers only.

We reserve the right to vary these terms and conditions at any time, but in respect of any ordered goods, the terms and conditions which apply shall be those which you accepted when placing your order.

First Shoes Competition

  • To enter the monthly Clarks First Shoes Prize Draw, the Prize Draw entry form must be fully completed and returned to a member of Clarks store staff.

  • No proof of purchase is required.

  • After personal details from the entry form have been entered onto the Clarks database, the entrant will be included in every monthly Prize Draw for a period of up to 60 months.

  • 1st prize – Clarks vouchers equivalent to approximately 10 pairs of kid's shoes (£300/€340 (exchange rate correct at time of print)). 10 runners up prizes of Clarks vouchers equivalent to 1 pair of kid's shoes (£30/€27). There are 2 monthly runners up prizes per region (England, Scotland Wales, Northern Ireland and EIRE). No cash alternatives to the stated prize will be available.

  • One entry per household.

  • The Prize Draw will take place on the 1st of every month, supervised by an independent witness. Winners will be notified in writing and sent prizes within 14 days.

  • A list of winners will be made available by contacting Customer Care Dept, Clarks, 40 High Street, Street, Somerset BA16 0EQ.

  • A copy of these Terms and Conditions can be retained by entrants by requesting a blank Prize Draw form from Clarks store staff.


Pricing

Clarks has taken every care in the preparation of the content of this website, in particular we try to ensure that all the prices shown on the website are accurate. Where a product's correct price is lower than that paid, we will refund the difference to you, and despatch your order in the usual way. Where the correct price is higher you will have the option of proceeding with the order at the correct price, or canceling the order. Where a reduced price is shown on sale, the item(s) have been on sale at the higher price for 28 days or more.

Reduced products will show the 'now price' and 'was price' with banners reflecting the discount level by £ off or % off. The reductions shown are reductions from the original ('was price') charged on the website. All products offered at a reduced price will be available for home delivery only.

Pricing and availability information is subject to change without notice.

All prices are quoted in UK pounds sterling. All prices are inclusive of VAT but do not include delivery charges. Some children's shoes are exempt of VAT.

Prices of goods displayed in and ordered through the website may differ from prices in store.


How your order is processed

After you have placed an order with us, we will send an email acknowledgement of that order to your designated email address. This email is a confirmation and receipt of your order.

If after we have confirmed your order we discover any unforeseen reason as to why we cannot complete it, we will cancel your order, in full or in part, and advise you by email, text or phone call, and refund when necessary.


Availability

Our receipt of your offer to purchase our goods is subject to their availability. Our acknowledgement of order acceptance via the web or email is not a guarantee of delivery. If we are unable to deliver the goods which you have offered to purchase we will tell you as quickly as possible and a full refund will be given. Please note that despatch estimates are not guaranteed and that despatch times should not be relied upon as such.


Payment

Payment can be made using the following major credit and debit cards:
Visa, Mastercard, Maestro, and Electron. Payments can also be made via PayPal if you are a verified user (click here for more info). Please note: as of 28th Feb 2011, we will no longer accept Solo as a method of payment.


Governing law and jurisdiction

The agreement between us shall be governed by and interpreted in accordance with English law and the jurisdiction of English courts.

These terms and conditions, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the goods to you by us. Nothing said by any person on our behalf should be understood as a variation of these terms and conditions.


Delivery

All deliveries are subject to stock availability and authorisation of your payment.

We can either deliver your order to an address of your choice or a selected Clarks store. The delivery address must be in the UK, and hold a valid postcode. We do not deliver to Eire, the Channel Islands or BFPO addresses.

For home delivery, the delivery charge is the same, irrespective of the number of items ordered. (The maximum order you will be able to make is sixteen items/pairs of shoes, of which no more than two sizes can be of the same style).

Standard Delivery
For mainland UK and Northern Ireland there is no delivery charge for orders placed in store or online. Delivery is within five working days for mainland UK and Northern Ireland, and within seven days for outlaying areas.

By providing us with your mobile phone number when placing your order, our parcel carrier will be able to text you when your item is on its way. If this delivery date is not convenient for you, you will be able to select an alternative delivery date by replying to this text.

Next Day Delivery
The next day delivery service applies on orders placed before 3pm Monday - Thursday. Orders placed on Friday and Saturday will be delivered on Monday, and orders placed on a Sunday will be delivered on a Tuesday. The next day delivery service is only available in areas as specified by our courier service. If the service is not available in your area it will not be shown as an option once you have selected your delivery address. Where we do not offer a next day delivery service, we may offer express delivery instead. Delivery times cannot be guaranteed.

Deliveries are normally made Monday-Saturday from 7am-7pm (excluding Bank Holidays). You will receive a confirmation of despatch to your chosen email account, and you can track your items by logging into your account on the Clarks website.

In the unlikely event that you receive the wrong order, please contact us as soon as possible so we can arrange for the item(s) to be collected and the correct one(s) to be dispatched to you.

If you have any questions about the delivery of your order, please call our customer care team on 08444 995544. Lines are open Monday to Saturday 8.30am to 8pm (excluding Christmas day, Boxing day and New Years day).

For items ordered for collection at store, there is no delivery charge. Delivery to the store specified by you at the time of order will be within five working days. You will receive an email or SMS confirmation that your order has arrived, and it will be held at the store for seven working days for your collection. After this time, the shoes will cease to be reserved for you and will return to general store stock.

Please note that Next Day is a proof-of-delivery service, and requires a signature on delivery.



Returns

We make every effort to ensure that your order is carefully despatched to you, and we hope that you're happy with your purchase. However, if you have any cause for dissatisfaction with your goods you may return them.

Items must be in their original condition, unworn and returned within 28 days of receiving them. You should follow the procedure below.

i) Direct to a Clarks store
For an immediate refund, you can return the items to any Clarks store, (with the exception of the Heathrow airport store, outlet/discount stores, and stores in the Channel Islands or Eire), within 28 days. You may also exchange your items in store. For a full list of all Clarks stores please see our website Store Locator.

What to do:-

Take your items to be returned to the Clarks store of your choice. You MUST have:

  • Your despatch note and a completed returns note (at the bottom of your despatch document)

  • The credit/debit card used to make the original purchase

If the item is in its original condition, we will process the refund for you.

ii) Return by post

You can return any items to us, free of charge at any Post Office or over 4,200 Collect+ stores, within 28 days of receipt.

What to do:-

  • Complete and detach the returns note (at the bottom of your despatch document) and enclose it, together with your returned items, inside the original packaging. Goods cannot be returned without this information.

  • Returns via Post Office;

  • Peel off the returns label from your delivery note and attach it on the outside of the parcel over your address.

  • Take your parcel to any Post Office, remembering to obtain a Proof of Postage receipt. You must retain this until the item(s) are credited on your statement, as this enables us to trace your order.

  • Returns via a Collect+ store;

  • Write your order number on the Collect+ label

  • Peel off the returns label from the Collect+ document and attach it on the outside of the parcel over your address

  • Take your parcel to any of the 4200 local Collect+ stores. You'll receive proof of postage and a code to track your return online. You must retain this until the item(s) are credited on your statement, as this enables us to trace your order.

  • You can find your nearest Collect+ store by texting COLLECT and your Postcode (e.g. COLLECT BA16 0EQ) to 84555 or at www.collectplus.co.uk/clarks

  • Texts from 84555 are FREE to receive, texts to 84555 are charged at your standard network rate. Full terms and conditions at www.collectplus.co.uk/smsterms

iii) Call us to arrange collection

What to do: -

  • Call our customer care team on 08444 99 55 44. Let them know what you would like collected and where from. They will then give you a date for collection.

    If the item we collect is in its original condition we will process the refund for you. There is no charge for this service.

We cannot process any exchange requests by post. If you require an exchange, please take your item to a store of your choice and we will be happy to help. We will process your refund within 14 days of receiving your return.

All of this is in addition to and does not affect your statutory rights.


Right to cancel this agreement

Under the Distance Selling Regulations, you have seven working days starting the day after delivery (the 'cooling-off period') in which to cancel this agreement, if for any reason you are not happy with the goods that have been delivered.

If you wish to cancel this agreement, you must notify us, and return the goods that have been delivered to you using the free of charge returns label included.

Goods are refunded within 30 days.


How you can cancel this agreement

Please contact us as soon as possible if you wish to cancel your order, you can do so by writing to us, calling 08444 99 55 44, or going through the contact us page on our website. Orders can only be cancelled before processing/despatch has begun.

Once your order has been cancelled, any sum debited from your payment card by us will be re-credited to your account as soon as possible. If cancelled orders are erroneously delivered to you, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.


How Clarks can cancel this agreement

We reserve the right to cancel the order if:-

  • We have insufficient stock to fulfil your order

  • We are unable to obtain payment

  • We do not deliver to your area

  • A product fault or an error in the product description has been identified


Use of the Clarks Website


Ownership of rights

All rights, including copyright, in the text, graphics and layout of this website and in all software and software compilations are owned by, or licensed to, Clarks.

You are not permitted, without our prior written consent, to copy, transmit, reproduce, publish, display, distribute, store, modify or adapt this website, its contents or underlying software, except for personal non-commercial use.


Accuracy of content

We have made every effort to ensure that the products are fairly described, that the product information is correct, and that the colours of our products are displayed as accurately as possible. However, as the actual colours you see will vary with the quality of your monitor, we cannot guarantee that your display will accurately reflect the colour of the product requested on delivery.

If, on receiving ordered goods, you have any cause for dissatisfaction you may return them via our Returns procedure, which is explained below.

We may establish general practices and limits concerning the use of the website and the services we provide, including limits to the size and number of any messages that have been sent, or the duration that any messages may be stored on our website. We are entitled to delete any material from our website at any time, and we will not be liable for deleting or not storing any material that you may transmit to us.


Damage to your computer

Clarks make every effort to ensure that this website is free from defects or viruses. It is your responsibility to ensure that you use the correct equipment when using the website, and to protect from anything that may damage it.


Links to other websites

We take no responsibility for the content or operation of third party websites that you may access following links from this website. We strongly advise that you read the privacy policy and terms and conditions relating to any third party websites that you visit.

We do not hold any responsibility for any site, or its content, that has chosen to link to us.


Product reviews

You may leave a review of a product on its specific product page. We will review product and publish product reviews within 4-5 working days of posting, and we will directly contact a customer where a review indicates a problem with a product. If we choose not to post a review we will contact the customer via their Clarks account to explain why. We reserve the right to edit or delete illegal or inappropriate content. We will not change a rating once set by a customer.

We reserve the right to use customer reviews (in full or part) in our marketing materials. These may include in-store, online, email and direct mail marketing.


Password and security

If you use the site, you are responsible for maintaining the confidentiality of your account and password, and also for ensuring that unauthorised access to your account is prohibited. You should take all necessary steps to ensure that your information is kept confidential to you. If you have reason to believe that this may have been compromised, please contact us immediately.
